2. Who can purchase
These terms are primarily intended for consumers purchasing products for purposes outside their trade, business, craft, or profession. By placing an order, you confirm that you have the legal capacity to enter into a contract. If you are under the age of majority, you may only make a purchase where permitted by applicable law and with the involvement or authorisation of your legal representative where required. If you wish to purchase as a business or professional, please contact ARTNUEVO to discuss the applicable terms.
3. Products and descriptions
ARTNUEVO offers artworks, paintings, decorative objects, and other products described on the relevant product pages. Photographs, dimensions, materials, finishes, and other relevant characteristics will be provided in each product description, where applicable. Due to the artistic or handmade nature of certain products, minor variations in colour, texture, finish, or appearance may occur. Such variations do not limit your statutory rights or justify a lack of conformity of the product. Where a product is made to order or can be customised, the specific characteristics agreed with the customer will be stated in the product description or order confirmation.
4. Placing an order
To make a purchase:
- Select the products you wish to buy and add them to your shopping basket.
- Enter the requested information and, where applicable, your delivery address.
- Select an available payment method.
- Review the order summary, including products, quantities, prices, taxes, and shipping costs.
- Correct any errors and confirm your order using the button clearly indicating the obligation to pay.
Once your order has been received, ARTNUEVO will send an electronic confirmation containing the details of your purchase. Automatic receipt of an order confirmation does not necessarily mean that the order has been finally accepted if the store provides for a subsequent acceptance stage. In such cases, the customer will be clearly informed when the contract is concluded. You are responsible for ensuring that the information provided is accurate. Please notify ARTNUEVO of any errors as soon as possible using the available contact details. If an obvious error is identified in a product’s price or description, ARTNUEVO will contact you to explain the issue and, where appropriate, offer you the option to confirm the order on the correct terms or cancel it for a full refund of the amounts paid.
5. Prices, taxes, and payment methods
Prices will be displayed in euros and will include applicable taxes where required by law. Any additional charges, including shipping costs, will be disclosed before you complete your purchase. The price applicable to your order will be the price displayed when the order is placed, except in the case of an obvious error handled in accordance with applicable law. Available payment methods will be displayed during checkout. Payments may be processed by third-party payment service providers. ARTNUEVO will not ask you to send your full bank card details by email. Payment information will be handled in accordance with the applicable provider’s terms and security measures. If you require an invoice, you may request one through info@artnuevo.com, providing the information necessary for its issuance.
6. Shipping and delivery
ARTNUEVO ships to the destinations listed in the online store at the time of purchase. Shipping charges, available destinations, and estimated delivery times will be displayed during checkout. Unless another period has been expressly agreed, products will be delivered without undue delay and within the maximum period required by applicable law. Where no other period has been agreed, the general statutory delivery period for consumer purchases will apply. The risk of loss or damage passes to the consumer when the consumer, or a third party designated by the consumer other than the carrier, obtains physical possession of the goods, unless the consumer has independently commissioned a carrier not offered by ARTNUEVO. If a parcel arrives visibly damaged, we recommend keeping the packaging and contacting ARTNUEVO as soon as possible. This does not affect your statutory rights.
7. Customised products and made-to-order artworks
Where ARTNUEVO offers customised or made-to-order products, the agreed characteristics, dimensions, materials, price, and estimated production or delivery time will be specified in the product description, quotation, or order confirmation. Custom work will begin in accordance with the terms agreed with the customer. Under applicable law, the right of withdrawal may not apply to goods made to the consumer’s specifications or clearly personalised. This exception will apply only where the relevant legal requirements are met. Customisation does not exclude the consumer’s legal rights in the event of a defect, lack of conformity, or failure to meet the agreed specifications.
8. Right of withdrawal and returns
Where the statutory right of withdrawal applies, consumers generally have 14 calendar days from receipt of the product to notify ARTNUEVO of their decision to withdraw from the purchase, without having to provide a reason. To exercise this right, you must send an unequivocal statement to info@artnuevo.com before the statutory period expires. You may use a withdrawal form provided on the website, if available, but its use is not mandatory. After notifying ARTNUEVO of the withdrawal, you must return the product within the applicable statutory period. Unless ARTNUEVO states otherwise or the law provides otherwise, you will bear the direct cost of returning the product where you were informed of this obligation in advance. ARTNUEVO will reimburse payments received, including standard delivery costs where legally required, within the time limits established by applicable law. Reimbursement may be withheld until the products have been received or you have supplied evidence of having returned them, whichever occurs first. You are only liable for any diminished value of the product resulting from handling beyond what is necessary to establish its nature, characteristics, and functioning. The right of withdrawal does not apply to statutory exceptions, including, where the legal requirements are met, goods made to the consumer’s specifications or clearly personalised goods. Withdrawal and returns are subject to applicable law and the further information provided in the Returns Policy.
9. Legal guarantee and lack of conformity
ARTNUEVO is responsible for any lack of conformity of products in accordance with Spanish consumer protection legislation. Where applicable, new physical goods are subject to the statutory three-year period of liability for lack of conformity from delivery, without prejudice to specific rules that may apply to certain products. If you receive a defective, damaged, or non-conforming product, contact ARTNUEVO at info@artnuevo.com, providing your order number and a description of the issue. You may include photographs where helpful. Depending on the circumstances and applicable law, consumers may be entitled to the remedies provided by law, which may include repair, replacement, a price reduction, or termination of the contract. Nothing in these terms limits your statutory consumer rights.
10. Intellectual property
Purchasing a physical product does not transfer any intellectual property rights in the artwork, design, photographs, illustrations, or related materials. Unless expressly authorised or permitted by law, you may not reproduce, distribute, sell copies of, or commercially exploit ARTNUEVO’s protected artworks or designs. Third-party rights, including trademarks, designs, and protected works, must be respected in accordance with applicable law.
11. Liability
ARTNUEVO will fulfil its obligations under applicable law regarding the sale, delivery, and conformity of products. Nothing in these terms excludes or limits any liability that cannot legally be excluded or limited, or any rights granted to consumers by law.
12. Personal data protection
Personal data provided during checkout will be processed to manage orders, payments, delivery, customer service, and applicable legal obligations. Where there is an appropriate legal basis and the relevant requirements are met, data may also be used for other purposes described in the Privacy Policy. Further information about data processing, your rights, and how to exercise them is available in the Privacy Policy.
13. Customer service and complaints
For questions, issues, or complaints relating to a purchase, you may contact ARTNUEVO at info@artnuevo.com. ARTNUEVO will handle communications within a reasonable period and in accordance with applicable legal obligations. Consumers may contact the relevant public consumer protection authorities and use available dispute resolution mechanisms in accordance with applicable law.
14. Governing law and jurisdiction
These terms are governed by Spanish law, without prejudice to any mandatory consumer protection rules that may apply where a customer resides in another country. Where the customer qualifies as a consumer, disputes will be handled by the courts with jurisdiction under applicable law. Nothing in this section limits any rights granted to consumers by law.
15. Changes to these terms
ARTNUEVO may update these terms where necessary, for example, due to legal, operational, or service-related changes. The terms applicable to each purchase will be those in force and applicable when the order is placed. Subsequent changes will not apply retroactively to contracts already concluded, unless required by law.
